yRuler, Inc (Tangiblee) Privacy Statement - Updated January 2023

yRuler, Inc. (“yRuler” or “Tangiblee” or “TNG”or “we” or “us” or ) provides an online service (the “yRuler Service”) to help our customers (“yRuler Clients”) make their products and services (“ClientServices”) more successful. In order to provide the yRuler Service, yRuler collects certain information, as described in this Privacy Statement, from both yRuler Clients, their end-user customers (“End Users” or “End User”) and visitors (“Prospective Clients” and/or “Individuals” and/or “Individual”) to https://www.tangiblee.com website (“Site”) (“Prospective Clients” and/or “Individuals” and/or “Individual”).

yRuler is deeply committed to protecting the privacy of both yRuler Clients, yRuler Clients’ End users (individuals who engage with Tangiblee on a client’s retail website) and, those Prospective Clients or ‘Individuals’ who visit Tangiblee.com. The purpose of this Privacy Statement is to inform you, as any yRuler Client or any End User, about our privacy practices. We encourage you to read this Privacy Statement in order to learn more about how we safeguard your privacy.

Who are yRuler Clients?

yRuler Clients are online retailers who use the yRuler Service to present their products in context and scale. This type of presentation provides the End Users better shopping experience. Please be sure to review the privacy policies of any online services that you may use, as we do not control third parties.

Who are yRuler Client End Users?

“End Users” is an individual engaging with theyRuler/Tangiblee service on any of yRuler Clients’ retail websites.

Who are yRuler Prospective Clients or Individual/s?

Any person visiting, viewing, and/or receiving content from our company website, Tangiblee.com, and/or any of its affiliated website pages or subdomains.

yRuler/Tangiblee PROSPECTIVE CLIENT OR INDIVIDUALS

You may choose whether or not to provide or disclose Personal Data in connection with your use of Tangiblee Site. If you choose not to provide the Personal Data we request, you may still visit and use parts of our Site, but may be unable to access or use certain features, options, programs, and services. Our Site may contain links to third-party websites and services that are not owned or controlled by Tangiblee or yRuler. We are not responsible for the privacy practices or the content of third party websites, services, and advertisements, and you visit them at your own risk.

Introduction:

We are committed to respecting privacy and recognize the need for appropriate protection and management of any Personal Data that is shared with us as part of using any Tangiblee or yRuler website. As used in this Privacy Policy,"Personal Data" means any information that may be used, either alone or in combination with other information, to personally identify an individual.

Changes to this Privacy Policy.

We reserve the right, at our discretion, to change the terms of this Privacy Policy at any time. You can see when this Privacy Policy was last updated by reviewing the “Last Updated” legend on the top of this page. We may provide you with notice of material changes to the Privacy Policy as appropriate under the circumstances.

Information Collected.

We may receive and/or collect Personal Data in the following ways:

3.1. Personal Data You Provide To Us On Our Site.

If you send us a "Contact Us" request or feedback, or in connection with setting up an account on our Site, or if you use any of our free tools, or when you download any of our content, you may be required to provide us with certain information that may constitute Personal Data, such as:

If an End User uses the Tangiblee service and for such purpose uploads a photo, Tangiblee may use such photo to provide and improve the Tangiblee service and for that purpose Tangiblee may retain the photo for up to 12 months from the date the photo was taken by the user.

3.2. Personal Data You Provide To Third Parties On Our Site.

Please note that we use certain third-party service providers on our Site to enhance your experience or deliver certain services. These providers may collect Personal Data in performing their services and/or functions on our Site. 3.3. Information Collected Automatically:

Certain information on our Site is collected automatically by means of various software tools. We have a legitimate interest in using such information to assist in log-in, systems administration purposes, information security and abuse prevention and detection, to track user trends, and to analyze the effectiveness of our Site. Log Files On Our Site.

The information inside the log files includes internet protocol (“IP”) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us.

Cookies. We use cookies to make interactions with our website easy and meaningful. When you visit our website, our servers may send a cookie to your computer. Standing alone, cookies do not personally identify you; they merely recognize your web browser. Unless you choose to identify yourself to us, either by responding to a promotional offer, opening an account, or filling out a web form, you remain anonymous to us.

We may use cookies that are session-based and persistent-based. Session cookies exist only during one session. Other Tracking Technologies.

When you visit our Site, we may collect yourIP addresses to track and aggregate non-Personal Data. For example, we may useIP addresses to monitor the regions from which you navigate our Sites.  We may also use web beacons alone or in conjunction with cookies to compile information about your usage of our Site and interaction with emails from us.Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular site tied to the web beacon. The Purposes For Which We Use Personal Data.

If you submit or we collect Personal Data through our Site, then such Personal Data may be used in the following ways:(i) to provide, analyze, administer, and improve our Site and services, (ii) to contact you in connection with our Site and certain services, notifications, events, programs or offerings that you may have registered for, (iii) to send you updates and promotional materials that you have registered for, (iv) to identify and authenticate your access to the parts of our Site and services that you are authorized to access; (v) for recruiting and human resources administration purposes, and (vi) to protect our rights and/or our property and to ensure the technical functionality and security of our Site.

How We Disclose Personal Data.

We do not sell, lease, rent or otherwise disclose the Personal Data collected from our Site to third parties unless otherwise stated below or with your consent.

Business Partners.

From time to time, we may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share Personal Data collected in connection with your purchase or expression of interest with our joint promotion partner(s). We do not control our business partners’ use of Personal Data we collect, and their use of the information will be in accordance with their own privacy policies. We do not share Personal Data with business partners unless you are specifically opt-into such sharing via an event registration form. If you do not wish for your Personal Data to be shared in this manner, you may choose not to opt-in via event registration forms.

In the Event of Merger, Sale, or Change of Control:

We may transfer or assign this Privacy Policy and any Personal Data to a third party entity that acquires or is merged with as part of a merger, acquisition, sale, or other change of control.

Other Disclosures.

We may disclose Personal Data about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our terms of use, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of yRuler (Tangiblee), it’s users or the public.

yRuler does not collect, capture, purchase, receive through trade, otherwise obtain, disclose, re-disclose, or otherwise disseminate a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry used to identify a person. yRuler only determines the existence of certain parts of the body and then merely returns a set of coordinates where a product image is superimposed. The determination of the existence of certain parts of the body and the set of coordinates where a product image is superimposed are not used to identify a person.

Retention of Personal Data.

We reserve the right to retain any PersonalData as long as the Personal Data are needed to: (i) fulfill the purposes that are described in the above section; (The Purposes For Which We Use PersonalData), and (ii) comply with applicable laws.

Your Rights:

If you have an account on our Site, we provide access to—and the ability to edit or delete—certain categories of Personal Data through the account.

We will promptly review all such requests in accordance with applicable laws. Depending on where you live, you may have aright to lodge a complaint with a supervisory authority or other regulatory agency if you believe that we have violated any of the rights concerningPersonal Data about you. Opting-Out of Promotional Emails.

You may choose not to receive future promotional or advertising emails from us by selecting an unsubscribe link at the bottom of each email that you receive from us, or by responding to the emails directly and requesting removal if such a link is not available. Additionally, you may send a request specifying your communications preferences to privacy@tangiblee.com. Customers cannot opt out of receiving transactional emails related to their account with us or our services. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any "Contact Us" request as well as administrative, maintenance and operational emails (for example, in connection with a password reset request).

Data Security.

The security of Personal Data is important to us. We follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Data, we cannot guarantee its absolute security.

Children's Privacy.

Our Site is not intended for children under the age of 18. Accordingly, we do not intend to collect Personal Data from anyone we know to be under 18 years of age.

How Do We Respond to Do Not Track Signals?

Tangiblee does not track Site users over time and across third-party websites to provide targeted advertising. Accordingly, we do not currently respond or take any action with respect to web browser"do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Data about an individual consumer's online activities over time and across third-party websites or online services.

CLIENT END USER INFORMATION

What information does yRuler collect regarding End Users?

It is at yRuler Clients’ discretion what actions and information they collect from each End User. However, yRuler requires yRuler Clients to observe all applicable laws and regulations relating to the protection of data privacy and to only collect information that is necessary to improve Client Services and successfully serve their End Users.The primary use of yRuler is to understand how End Users are using the yRulerClient’s service. Many yRuler Clients send us, on a per-user basis, a subset of the actions taken by each End User within such yRuler Clients’ services and when such actions were taken.

Does yRuler require yRuler Clients to inform the End User about their use of the yRuler Service?

We require that all yRuler Clients maintain a truthful and accurate privacy policy that discloses the type of information collected, and that the information is shared with third-party service providers for the purpose of improving performance. However, yRuler does not require yRuler Clients to disclose that information is shared with yRuler in particular, so yRuler Clients’ privacy policies may not name yRuler specifically. In addition, yRuler conducts routine audits on the data provided to us by yRuler Clients to monitor compliance with our agreements with yRulerClients, this Privacy Statement, and applicable data privacy laws and regulations.

How does yRuler use the information it collects?

The information yRuler collects on End User activities with Client Services is the property of the yRuler Client, not of yRuler. We store the data in a unique security domain for each yRuler Client.Our algorithms process and analyze each yRuler Clients’ data separately to give that yRuler Client insight into how their service is being used, how it could be improved, and how to better serve its End Users.

yRuler also aggregates information across yRuler Clients to (i) improve the yRuler Service, (ii) benchmark usage patterns and behavior for a particular yRuler Client and for yRuler Clients generally,(iii) publish the interesting analysis of trends or behaviors and (iv) other similar uses.

Will yRuler provide information about me to anyone else?

Except as provided below in the sections entitled Information Disclosed Pursuant to Business Transfers and InformationDisclosed for Our Protection and the Protection of Others, we never divulge EndUser data in a personally identifiable, unique or non-aggregated manner to anyone other than the yRuler Client on whose behalf we are collecting and analyzing its End User data.

How does yRuler make sure my information is secure?

yRuler takes the security and privacy of yRuler Client data and End User data very seriously. We use industry-standard best practices to secure our systems and access to the data. Each yRulerClient’s data is kept separate from each other yRuler Client’s data. Each yRuler Client’s data flows through our system in a separate message queue, is stored in separate files on disk, and is a part of a unique security domain.Access to that security domain is protected by user authentication. However, no method of transmission over the Internet and no method of electronic storage is100% secure. Therefore, while we strive to use industry standard best practices to protect your Personal Information, we cannot guarantee its absolute security.

Does yRuler use "cookies"?

Like many websites, we sometimes employ “cookies,” small packets of data, which may include an anonymous unique identifier that is sent to a user’s browser from a website’s computer and stored on the user’s computer’s hard drive. The website placing the cookie on the user’s computer can then recognize the computer when the user navigates the website at a later time. For example, this allows us to remember user preferences and measure user behavior, information that yRuler Clients may then use to improve user interaction with their services.

Yes, yRuler makes use of first-party cookies. Although most web browsers automatically accept cookies, your browser setting can usually be modified to decline cookies or alert you when a website is attempting to place a cookie on your computer. Consult the help manual for your browser for detailed information. For further information about disabling cookies, visit www.allaboutcookies.org. If you choose to decline cookies, you may lose some of the functionality associated with certain yRuler Clients’ services that are provided by the use of cookies. Please refer to the privacy policy of the company that is a yRuler Client for more information about its interactive features that depend on cookies.

Does yRuler use a web tag or javascript beacon?

How data is collected and sent to yRuler is at the discretion of the yRuler Client. yRuler does provide a javascript beacon that yRuler Clients can integrate with their online service to collect usage data. If the yRuler Client uses this javascript beacon, data is sent directly from the End User’s browser to yRuler for storage and analysis.

Are there ways that I can opt-out of allowing a yRuler Client to collect data on my use of its service?

Yes. If you are an End User of a yRuler Client and do not wish for us to collect information about your use of that service, there are several options:

  • We respect the “Do Not Track” Settings on most modern browsers. Set this flag on your browser and we will not collect data from our javascript beacon. Remember to set this flag on each browser that you use.

  • Please review the privacy policy of the company that is a yRuler Client and follow that company’s instructions for opting out of data collection.
  • If you would like to opt-out of having your data sent to yRuler, please contact the yRuler Client directly to ask for this. If you feel the yRuler Client is not responding satisfactorily to your request, please contact us privacy@tangiblee.com and we will respond within 24hours of the request (during the workweek M-F) and within 48hours when submitted over weekends or holidays.

YRULER CLIENT INFORMATION

What information does yRuler collect on its Clients and how is it used?

We collect only data that is necessary to provide optimum service for our Clients. The information we gather enables us to personalize, improve and continue to operate the yRuler Service. To explain how we use and safeguard your data, let’s look at the types of information we collect:

Usage Data: We make use of our own service to understand how you are using the yRuler Service so as to maximize your success with us and to improve the performance of the yRuler Service. The entire preceding section with respect toEnd User Information applies to your own use of the yRuler Service.

Account Information: When you create a yRuler Service account, you will provide us with certain personally identifiable information (“PersonalInformation”), such as your name, contact information, and account username and password. We recognize that this information is very important to you and we promise we will never divulge any of your Personal Information to anyone without your permission except as described below in the Sections entitled InformationDisclosed Pursuant to Business Transfers and Information Disclosed for OurProtection and the Protection of Others. Please note that we may use yourPersonal Information to contact you regarding your account and the yRulerService.

Financial Information: If you pay for the use of the yRulerService by credit card, please be advised that we do not currently collect financial information, such as your payment method (valid credit card number, type, expiration date or other financial information); that information is collected and stored by our third party payment processing company (the“Payment Processor”), and use and storage of that information is governed by the Payment Processor’s applicable terms of service and privacy statement.Please note that we may from time to time request and receive some of your financial information from our Payment Processor for the purposes of completing payment transactions or enrolling you in programs in which you elect to participate, protecting against or identifying possible fraudulent transactions, and otherwise as needed to manage our business.

Email Communications: We may receive a confirmation when you open an email from us. We use this confirmation to improve our customer service.

Changing or Deleting your Information: If you are a yRuler Client, you may review, update, correct or delete the personally identifiable information in your yRuler account where it is inaccurate by contacting us. If you would like us to delete your yRuler account in our system, please contact us here with are quest that we delete your personally identifiable information from our database. We will use commercially reasonable efforts to honor your request. If you request that your personally identifiable information be deleted from our records, there may be a brief delay in processing that request, while verifying that the request is valid and originates from you as opposed to an unauthorized third party. If you request that your information is deleted, we reserve the right to terminate and/or limit your access to the Service. We may retain an archived copy of your records as required by law or for legitimate business purposes.

Phishing: We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in a non-secure or unsolicited email or telephone communication. GENERAL

Information Disclosed Pursuant to BusinessTransfers:

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that are transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of yRuler or our assets may continue to use your Personal Information as set forth in this policy.

Information Disclosed for Our Protection &the Protection of Others: We also reserve the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (i)satisfy any applicable law, regulation, legal process or governmental request,(ii) enforce our Terms of Service, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect our rights, property or safety, our users, and the public. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.

International Transfer:

yRuler may transfer your usage and business data, which may contain personally identifiable information, from your browser to our servers, located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information that contains personally identifiable information to us, yRuler transfers that personally identifiable information to the UnitedStates and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

EU SafeHarbor Compliance: yRuler complies with the U.S.-EU Safe Harbor Framework.

Third-Party Practices

Please be advised that we do not control and are not responsible for the privacy practices of any third party, including, but not limited to, yRuler Clients and any website or service that links to or from our website or the yRuler Service. While, as discussed above, we require that yRuler Clients maintain a truthful and accurate privacy policy disclosing their data collection practices, we cannot control the actions of yRulerClients, so please be sure to review the privacy policies of any online services that you may use.

Children

Our Service is not directed to children under the age of 13. We do not knowingly collect personally identifiable information from children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us here. If we become aware that a child under the age of 13 has provided us with personally identifiable information, we will delete such information.

Partnership with Adroll As you browse Tangiblee.com, advertising cookies will be placed on your computer so that we can understand what you are interested in. Our display advertising partner,AdRoll, then enables us to present you with retargeting advertising on other sites based on your previous interaction with [company website]. The techniques our partners employ do not collect personal information such as your name, email address, postal address, or telephone number. What happens when there are changes to this Privacy Statement?
